The Firm handles a wide variety of employment law matters for employers and executives. Client industries include banking, financial services, healthcare, energy, construction, insurance, manufacturing, private equity and personal services, as well as the public sector.

  • Defense of claims under the Fair Labor Standards Act, including collective actions
  • Defense of claims of age, sex, race, national origin, and disability discrimination and/or harassment, and claims of retaliation
  • Enforcement of and challenges to non-compete, non-solicitation, and confidentiality agreements (including hearings on temporary restraining orders and injunctions)
  • Defense of whistleblower claims under Sarbanes-Oxley, Sabine Pilot, and state whistleblower statutes
  • Defense of public employers at termination hearings before agency-appointed hearing examiners
  • Defense of claims under the Family and Medical Leave Act.
  • Defense of claims for unemployment compensation and unpaid wages before the Texas Workforce Commission
  • Counseling employers on policies and procedures to avoid litigation, including:
    • Management training in compliance and best practices
    • Seminars for non-management employees on basic employment law issues
    • Preparation of employee handbooks and policies
    • Investigation and audit of employment practices, including wage and hour compliance and discrimination complaints
    • Advising employers and senior executives on contract negotiation, compensation and obligations under non-competition agreements
    • Day-to-day advice on matters such as:
      • proper classification of workers
      • leave issues, including compliance with the Family and Medical Leave Act
      • disability accommodation and general ADA compliance
      • privacy issues o recordkeeping o employee discipline o termination decisions
